1. Acceptance of Terms

Welcome to BrilliantLeadly ("Company", "we", "our", "us"). By accessing or using our website, application, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of the terms and conditions contained herein, do not use the Service.

2. Description of Service

BrilliantLeadly provides a B2B lead generation platform that includes Google Maps bulk scraping, web scraping, CSV export, a lead pipeline, WhatsApp broadcast and inbox messaging, and optional CRM integrations. The Service allows users to search, extract, organize, and export publicly available business information.

We aggregate data that is already publicly available on the internet. We do not guarantee the absolute accuracy, completeness, or timeliness of any data provided through the Service.

3. Account Registration & Eligibility

  • You must be at least 18 years old and use the Service for legitimate business purposes.
  • You must provide accurate, current, and complete information during the registration process.
  • You are responsible for safeguarding your account credentials and for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • Accounts registered by "bots" or automated methods without explicit permission are strictly prohibited and will be terminated.

4. Acceptable Use Policy

You agree to use the Service only for lawful business-to-business (B2B) purposes. You explicitly agree not to:

  • Use the data for consumer (B2C) marketing in violation of local laws.
  • Violate any applicable anti-spam, privacy, or telecommunications laws, including but not limited to the CAN-SPAM Act, GDPR, CCPA, CASL, or Indonesia's UU PDP.
  • Use the Service to distribute malware, viruses, or any other malicious code.
  • Attempt to reverse engineer, decompile, or bypass the security mechanisms of the Service.
  • Resell, sublicense, or share your account access or the raw data provided by the Service as a competing standalone data product.

5. WhatsApp & Messaging Rules

If you use WhatsApp broadcast, inbox, or related messaging features, you acknowledge that BrilliantLeadly is a technology provider only. You are the sender and data controller for messages you send through your connected WhatsApp account.

  • You must comply with Meta/WhatsApp Business Policy, applicable anti-spam laws, and local telecommunications regulations.
  • You must obtain and honor valid consent or another lawful basis before sending promotional or unsolicited messages.
  • You must provide a clear opt-out mechanism and stop messaging recipients who opt out.
  • You are solely responsible for WhatsApp account restrictions, bans, number blocks, delivery failures, and complaints arising from your campaigns.
  • You must not send illegal, deceptive, abusive, or high-risk content, including phishing, fraud, or prohibited goods/services.
  • We may throttle, suspend, or disable messaging features if we detect abuse, excessive complaints, or legal risk.
  • Automated broadcast features include warm-up limits, daily caps, and send pacing. Disabling warm-up or exceeding recommended limits increases ban risk.
  • If WhatsApp restricts your account, we may reduce your session warm-up tier, flag the session, and pause active campaigns. You must resolve the issue and manage your session connection manually before resuming.

6. Data Sourcing & User Compliance

You are responsible for ensuring that your use of scraped or exported data complies with all applicable laws, platform terms, and industry rules in your jurisdiction.

  • You must comply with the terms of third-party platforms and websites from which data is sourced, including Google Maps and target websites.
  • You must not use the Service where scraping, export, or outreach is prohibited by law or contract.
  • You are solely responsible for obtaining any required notices, consents, or legal bases before contacting prospects.
  • BrilliantLeadly does not provide legal advice and does not guarantee that any specific use case is lawful in your country.

7. Billing, Credits, and Payments

Payment Processor: All payments, subscriptions, and transactions are securely processed by Dodo Payments, our merchant of record. By purchasing, you also agree to Dodo Payments' terms and conditions. Legacy subscriptions previously processed through Lemon Squeezy remain subject to that processor's terms until migrated.

Credits: The Service operates on a credit-based consumption model. Credits are allocated based on your subscription tier or via one-time top-ups. Unless your plan explicitly states otherwise (for example, Pro plan rollover), unused credits do not roll over to the next billing cycle.

Zero-Result Billing: Credits are deducted only for leads that contain at least one verified contact method (such as email or phone). Search batches that return zero contactable leads are not charged. This billing rule does not create a right to cash refunds for subscriptions or credit top-ups.

Taxes: All fees are exclusive of taxes unless stated otherwise. Dodo Payments will calculate and apply necessary taxes (such as VAT or sales tax) based on your location at checkout.

8. Subscription Cancellations

You may cancel your monthly or annual subscription at any time through your dashboard billing portal.

  • No Pro-rated Refunds: Canceling your subscription stops the automatic renewal. You will not receive a pro-rated refund for the remainder of your current billing cycle.
  • Continued Access: After cancellation, you will retain access to your plan's features and remaining credits until the end of your current paid billing period.

9. Refund Policy (Strictly No Refunds)

BrilliantLeadly operates on a "Strictly No Refunds" policy.

  • All Sales Are Final: Due to the digital nature of the credits and the immediate costs associated with data extraction, we do not offer refunds, returns, or exchanges for any purchases, including subscription fees and credit top-ups.
  • No Refunds for Unused Credits: If you cancel your subscription or your account is terminated, you will not receive a refund for any unused credits remaining in your account.
  • No Refunds for Renewals: It is your responsibility to manage your subscription. We do not provide refunds for automated renewals if you failed to cancel your subscription before the renewal date.
  • Zero-Result Billing Is Not a Refund: Not being charged for zero-contact leads is a credit consumption rule only. It does not convert into a refund entitlement for prior purchases.
  • Data Quality: As we aggregate publicly available data, we cannot guarantee the specific accuracy or deliverability of the leads. Consumed credits for successful data retrieval are non-refundable.

10. Chargebacks & Payment Disputes

We take fraudulent chargebacks very seriously. If you initiate a chargeback or dispute a valid transaction with your bank or credit card provider, your BrilliantLeadly account will be immediately permanently suspended, and any remaining credits will be forfeited. We urge you to contact our support team first to resolve any billing issues.

11. Intellectual Property Rights

The Service, including its underlying software, algorithms, designs, and branding, is the exclusive property of BrilliantLeadly. The publicly available business data extracted via the Service remains the property of its respective public owners. We claim no ownership over the raw business data, only the structured aggregation provided through our platform.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, nor do we warrant the accuracy of the contact data generated or the continued availability of third-party platforms such as WhatsApp or Google Maps.

13. Limitation of Liability

IN NO EVENT SHALL BRILLIANTLEADLY, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) THE USE OF DATA OBTAINED FROM THE SERVICE FOR OUTREACH; OR (IV) WHATSAPP ACCOUNT BANS, MESSAGE DELIVERY FAILURES, OR PLATFORM POLICY ENFORCEMENT.

14. Indemnification

You agree to defend, indemnify, and hold harmless BrilliantLeadly from and against any claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the Service, or your violation of any term of these Terms (specifically including violations of anti-spam, privacy, scraping, and messaging laws during your campaigns).

15. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. We may delete or deactivate account data in accordance with our Privacy Policy and applicable law.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

17. Governing Law & Disputes

These Terms are governed by the laws of the Republic of Indonesia, without regard to conflict-of-law principles. You agree that the courts located in Jakarta, Indonesia shall have exclusive jurisdiction over disputes arising from or relating to these Terms or the Service, unless mandatory local consumer protection law requires otherwise.
